TERMS AND POLICIES

Terms of Service

Effective date: August 1, 2026

Agreement and scope

These Terms govern pepmax.com and the nonclinical services provided by PEPMAX LLC, a Delaware limited liability company doing business as PepMax ("PepMax," "we," "us," or "our"). Our registered address is 1925 Lovering Avenue, Wilmington, DE 19806, US. Questions and notices may be sent to support@pepmax.com.

By affirmatively accepting these Terms when registering or purchasing, you agree to them. Please read them before placing an order. Our Shipping and Refunds Policy forms part of this agreement. Our Privacy Policy and Consumer Health Data Privacy Policy explain our handling of information. Clinical services require the applicable provider's separate consents and notices.

THE DISPUTE RESOLUTION SECTION BELOW CONTAINS AN INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT EXPLAINS YOUR RIGHT TO OPT OUT WITHIN 30 DAYS.

Who provides the services

PepMax provides administrative, marketing, technology, billing, and customer-support services. PepMax is not a medical practice or pharmacy and does not diagnose, prescribe, determine medical necessity, compound, or dispense medication.

Medical services are provided by MDI Medical Group PC and, where applicable, its affiliated professional entities (the "Medical Group") through independently licensed clinicians ("Providers"). Providers exercise independent clinical judgment. Payment, a product selection, or a prior prescription does not require a Provider to approve treatment, prescribe a particular product or dose, or continue treatment.

Prescription medications are dispensed and shipped by independent, state-licensed pharmacies pursuant to valid, patient-specific prescriptions and applicable 503A compounding requirements. Availability depends on your location, prescription, and pharmacy authorization. Your dispensing pharmacy and its contact information appear on your medication label. PepMax coordinates orders and customer support but does not prescribe, compound, or dispense medication.

PepMax may coordinate authorized orders and fulfillment information but cannot alter a prescription or override professional medical or pharmacy decisions. The Medical Group and pharmacies remain responsible for their respective professional services and records. Their separate terms, consents, and privacy notices may apply.

Eligibility and nationwide access

You must be at least 18 and legally able to consent to the services. Use your own identity and provide complete, accurate information, including your physical location at each clinical encounter, medical history, medications, allergies, and delivery address. Do not submit an order for another person through your own account.

PepMax offers access across all 50 states. Particular treatments remain subject to the patient's location, provider, and pharmacy authorization, clinical eligibility, product availability, and law. Nationwide access does not mean every medication or formulation is available to every patient in every state. International delivery is not offered through this program.

The services are not for emergencies. Call 911 or seek immediate local care for an emergency. Routine messages may not be reviewed immediately.

Prescription products and regulatory status

All medication requests require clinical review and a valid patient-specific prescription before dispensing. PepMax does not sell or supply research-use-only products, research chemicals, or products labeled not for human consumption. You may not obtain products for resale, redistribution, experimentation, or use by anyone other than the named patient.

Compounded medications are not approved by the U.S. Food and Drug Administration (FDA). FDA does not review each compounded preparation for safety, effectiveness, or quality before marketing. Approval of a branded drug containing an ingredient does not extend to a compounded preparation containing that ingredient. Pharmacy licensure, a prescription, testing, or a certificate of analysis is not FDA approval.

Scientific evidence varies by ingredient, route, and formulation. Some offered peptides and combinations have limited human safety and efficacy data, including limited long-term data, and combinations may not have been adequately studied. Treatment may involve ingredients without an FDA-approved drug product or uses outside an approved product's labeling. These are distinct situations. Your Provider will explain the proposed treatment, material risks, uncertainties, alternatives, and necessary monitoring. Pharmacy oversight and a prescription do not eliminate uncertainty or adverse-effect risk. No improvement, particular result, or absence of adverse effects is promised. Follow only the directions accompanying your prescription and ask your Provider or pharmacist if anything is unclear.

Availability may change if a Provider or pharmacy declines treatment, supply changes, or legal or regulatory requirements change. Listing a treatment does not guarantee prescribing, lawful availability in a particular circumstance, or fulfillment. We may suspend or remove an offering and will apply the Shipping and Refunds Policy to paid products or services that cannot be supplied.

Purchases and payment

Your checkout identifies the selected service period, total price in U.S. dollars (USD), included components, and any applicable taxes or shipping charges before you authorize payment. Options may include one-, three-, or six-month service periods paid in full after prescribing. A displayed monthly equivalent is a price comparison, not a monthly installment schedule. Discounts and promotions apply only on the eligibility, duration, and other conditions disclosed with the offer; a promotion does not guarantee clinical approval.

The checkout description controls what is included, including consultation, medication if prescribed, supplies, shipping, and any separately stated charges. No fee for an optional or additional service will be imposed without disclosure and authorization. Services are cash-pay; PepMax does not submit insurance claims or promise insurance, HSA, or FSA reimbursement.

A service period is not a guarantee of continuous medication use, a fixed dose, an exact number of injections, or a single shipment covering the entire period. Prescription quantity, dosing schedule, follow-up requirements, and shipment timing are determined by the Provider and pharmacy. Clinical reassessment or staged dispensing may be required during a prepaid period. Checkout must identify when that service period starts; medication directions and days' supply are shown separately.

At checkout, you authorize the total disclosed for your selected purchase and represent that you are entitled to use the payment method. We may place a temporary authorization hold to verify availability of funds. An authorization is not a completed charge, although it may temporarily reduce your available balance. We collect payment only after a Provider approves treatment and issues a valid prescription. If treatment is declined or you cancel before prescription issuance, we cancel or release any uncaptured authorization; your bank determines when the hold disappears. If an authorization expires, a new authorization may be required before the order can proceed. We will not collect a higher amount or charge for a different purchase without your authorization.

PEPMAX LLC is the merchant responsible for your PepMax purchase, billing support, refunds, and payment disputes. Your receipt identifies the seller and the statement description used for the charge. Payment services are supplied by third-party payment providers. A saved payment method requires your authorization and does not permit an automatic renewal or unrelated charge. Questions about an unfamiliar, duplicate, or incorrect charge may be sent to support@pepmax.com; do not send full card details.

Follow-up visits and repeat purchases

Prepaid plans do not renew automatically merely because time passes or a payment method is stored. Repeat billing occurs only after you complete the required follow-up visit and authorize the price and service period of the next purchase. Completing a follow-up alone does not authorize an undisclosed charge or guarantee a prescription. You may decline a new purchase without an automatic renewal charge.

You must complete any required intake, consultation, laboratory work, or reassessment before the applicable treatment or dispensing can proceed. Failure to complete these steps may delay an order. Contact support promptly if you no longer wish to proceed. Existing paid orders are governed by the Shipping and Refunds Policy.

Order finality and remedies

An initial order ordinarily becomes final once a Provider approves treatment and issues its prescription. An authorized repeat order becomes final when supported by a valid prescription and transmitted for pharmacy processing. These cutoffs address change-of-mind cancellations; they do not permit us to retain payment for products or services we cannot provide or eliminate remedies for a dispensing error, defect, recall, or other legally protected claim.

We may correct catalog or pricing errors before fulfillment. If a correction materially changes your order or increases its price, we will obtain your agreement or cancel and refund the affected portion. A treatment or formulation change requires the appropriate clinical authorization and patient consent where required. PepMax support cannot make clinical substitutions.

Delivery and patient responsibilities

Check your complete shipping address, including unit number, before submitting an order. Notify us immediately of a correction. An address change is not effective until confirmed and may no longer be possible after pharmacy processing. Pharmacy handling and carrier transit are separate; an expedited shipping service does not promise next-day delivery from checkout.

Retrieve shipments promptly and follow the actual pharmacy label for storage, reconstitution, use, beyond-use date, and post-puncture discard instructions. A plan duration or remaining quantity does not extend a vial's permitted use. Ask the pharmacy about unclear directions, temperature concerns, or damaged packaging before using the product. Do not use a suspected defective, incorrect, or recalled product.

Where an address error or other customer-caused delivery issue requires another shipment, we may offer reshipment at a disclosed charge subject to pharmacy approval. We will not charge a new fee without first disclosing it and obtaining authorization. Responsibility for loss and any refund or replacement follows the facts, the Shipping and Refunds Policy, and applicable law; a carrier scan alone does not eliminate a valid claim.

Our Shipping and Refunds Policy covers shipping, delivery, cancellations, returns, refunds, and replacements and forms part of these Terms.

Accounts and acceptable use

Protect your password and notify support of suspected unauthorized access. Do not share credentials, impersonate another person, submit false information, attempt unauthorized access, bypass safeguards, introduce malicious code, scrape personal information, disrupt the site, or infringe anyone's rights. We may restrict access to address misuse, fraud, security threats, or legal requirements. Suspension does not cancel obligations to address paid but unprovided services or valid record-access requests.

PepMax owns or licenses its site content, branding, and software. You receive a limited right to use them for personal, lawful access to the services. No permission is granted to reproduce them commercially or use PepMax marks without authorization. Third-party names and marks belong to their owners.

If you provide nonconfidential suggestions, you allow PepMax to use them without payment. This does not grant rights to publish your medical information, private messages, identity, or testimonial. Any testimonial or public marketing use requires appropriate separate permission. Copyright complaints should identify the work, allegedly infringing material, contact details, a signature, and statements of good-faith belief and accuracy and authority; send them to support@pepmax.com. This contact is not a representation of registered DMCA-agent status.

Communications and external services

We may contact you about orders, clinical steps, delivery, security, and customer support using the details you provide, subject to law and your preferences. Electronic notices may satisfy writing requirements where legally permitted. Marketing email and text permissions are separate from acceptance of these Terms; marketing consent is not required to purchase. Follow unsubscribe instructions for marketing email or reply STOP to marketing texts, if offered. Standard messaging and data charges may apply.

External websites and third-party tools have their own terms and privacy practices. Links are informational and do not guarantee their content or services. Nothing here excludes responsibility that applicable law assigns to PepMax.

Platform warranties and liability

PepMax's nonclinical site and informational content are provided as available. To the extent permitted by law, we disclaim implied warranties concerning that platform and content, including merchantability, fitness for a particular purpose, and noninfringement. We do not promise uninterrupted or error-free operation. These disclaimers do not replace professional duties, express order commitments, or required product remedies.

To the extent permitted by law, PepMax and its personnel are not liable for indirect, incidental, special, consequential, or punitive losses arising from the nonclinical services. Aggregate liability for those claims is limited to the greater of $1,000 or the amount paid to PepMax for the product or service giving rise to the claim in the preceding 12 months. These restrictions do not apply to fraud, willful misconduct, gross negligence, liability for personal injury that cannot be limited, or any nonwaivable consumer, privacy, product, or professional rights. They do not excuse refunds required by the Shipping and Refunds Policy or law.

You are responsible for third-party claims caused by your fraud, deliberate unlawful use or knowing infringement of another person's rights. Any indemnity owed to PepMax is limited to those acts and does not cover PepMax's or a professional provider's own negligence, misconduct, or violation of law.

Dispute resolution and arbitration

Contact support@pepmax.com with "Legal Dispute" in the subject line, your contact details, a description of the problem, and the remedy requested. Either party may request good-faith informal discussions. Allow 30 days after receipt for resolution before arbitration, unless urgent relief or a filing deadline requires earlier action. Applicable limitation periods are tolled during this agreed informal process to the extent permitted by law.

Unless you opt out, unresolved disputes between you and PepMax about the site, marketing, payments, orders, or nonclinical services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement. A court decides whether an arbitration agreement was formed and whether a claim is covered; otherwise the arbitrator resolves the merits. Rules and filing information are available at https://www.adr.org/industries/consumer/.

Either party may use a small-claims court with jurisdiction. Either may request emergency court relief to protect against unauthorized access, misuse of intellectual property, or immediate harm while other claims proceed in arbitration. Professional malpractice or dispensing claims solely against an independent Provider or pharmacy are not governed by this PepMax arbitration agreement.

YOU AND PEPMAX WAIVE A JURY TRIAL FOR CLAIMS SUBJECT TO ARBITRATION AND AGREE TO PROCEED INDIVIDUALLY, NOT AS CLASS REPRESENTATIVES OR CLASS MEMBERS. This does not waive public injunctive relief or another remedy that cannot lawfully be waived. Such a claim may proceed in court if it cannot lawfully be arbitrated under these provisions.

Arbitration may occur remotely or at a reasonably convenient location consistent with AAA rules. PepMax pays the fees allocated to a business under those rules. The arbitrator may award the individual relief available under applicable law, including statutory attorney fees where available. Judgment on the award may be entered in a court with jurisdiction. If AAA declines administration because PepMax fails to satisfy its consumer requirements, you may pursue the dispute in court; this provision does not impose an alternative forum selected solely by PepMax.

To opt out, email support@pepmax.com with "Arbitration Opt-Out" within 30 days after first accepting these Terms. Include your name, account email, and an express statement that you opt out. Opting out does not affect access to services. An unenforceable arbitration provision will be severed to the extent possible without eliminating a nonwaivable right.

Changes and general provisions

Delaware law governs this agreement, subject to the Federal Arbitration Act and mandatory protections of your home state. Court proceedings not subject to arbitration may be brought in a court with jurisdiction in New Castle County, Delaware, unless applicable law permits or requires another forum, including the small-claims exception above.

We may revise these Terms prospectively and will identify the effective date and provide legally required notice. Material changes to accepted purchase commitments require any consent required by law. New dispute terms do not retroactively govern an already-noticed dispute without mutual agreement.

These Terms and incorporated purchase terms form the agreement for PepMax's nonclinical services. If a provision is invalid, the remainder continues where lawful. Nonenforcement is not a waiver. You cannot transfer an account or prescription. PepMax may transfer this agreement in a business reorganization or sale subject to applicable law and privacy restrictions. No provision creates an agency, partnership, or employment relationship. Professional providers benefit only from provisions expressly protecting their independent roles; these Terms do not release their professional obligations.
